Family Law

 

Family law is the term that is used to describe all the different legal processes that revolve around family issues. This can include divorce, child custody, child support, alimony , domestic violence, wills, etc. The intent of family law is to provide grounds on which each legal process can be resolved taking into consideration the laws that are in effect for a particular state in question and trying to ensure that the solution for any dispute does not trigger different disputes from other angles.

Some Of The Common Terms Described in Family Law

Domestic Violence

Physical violence from one partner can result in cuts, bruises and even death. When one partner files a complaint about domestic violence, then the attorney in charge will take the necessary steps to ensure that the abuser is punished. The result, however, will depend of what caused the perpetrator to react in an aggressive way and all angles will be studied to arrive at a solution. An attorney will work to ensure that the court requests that the accuser be prohibited to get within a certain distance of the victim. In cases where they share a house together then either the victim or the accuser will be guided about the necessary steps to live in separate houses and have separate lives or there are also cases where the perpetrator will be arrested and forced to spend some time in jail. This particular side of family law can be quite disturbing, and requires a great care on how both parties are approached.

Wills

Before a family member dies he or she may take out a will to determine who get what part of the assets and estate that is being left behind. A lawyer is usually the one that communicates this fact to the family that is involved once the person has passed away. There are cases where some family members will not be entirely satisfied with the portion that they received and may want to enter court using certain grounds to contest what is written in the will. The attorney ensures that the parties that were stated in the will receive the amounts that were allocated to them and in the event of any possible critics to enter court to change something, the attorney responsible for the case will also enter with the family/person trying to make the change. This is where family law pays a part to ensure that the wishes to the deceased are granted.

Child Custody

Once partners decide to separate then there are times when both have a legal battle to decide who gets the rights to stay with the children or child involved. The court will analyze the financial and mental condition of both parties to ensure that the child is awarded to be best side. This side of family law involves a lot of pain for both family and children, because in cases where the non-custodial parent is quite close to the child and has not been granted rights to visit or very limited rights then both can come of feeling scathed by the court's decision. There are also cases in which both partners are still married, but one is unfit to be a parent due to problems with drugs or not having the necessary means to support a family. The court will once again look at both parties that are involved and award the strongest and more favorable side the custody of the child.
